How long do I have to file my injury lawsuit? Generally speaking, unless a government/public entity is involved or other exception which could shorten the length of time, the Statute of Limitations in California requires you to file a lawsuit for your personal injury claim within 2 years after the date of your accident (California Code of Civil Procedure section 335.1). If you do not file your case within that time frame it will most likely be dismissed by the courts. Always seek legal advice as to the proper time limitation as this code section may not apply to your own circumstances and type of legal matter.
