What made you want to become a personal injury lawyer?

There are several reasons why I wanted to become a personal injury attorney. To begin with, starting in the early 1970's all the way to 2003, my father practiced plaintiff's personal injury law here in Orange County. I saw, firsthand, the significant difference he made in other people's lives that could not necessarily fight the large insurance companies on their own. Moreover, and for a time early on in my legal career, I worked for a law firm that practiced several areas of law including injury defense.

Practicing for the defense, it was evident the insurance carriers' first concern was their bottom line, not the well-being of the injured victim whether it was someone else or even their own insured. In 2003, after my dad passed away, I had the opportunity to turn something negative into a positive by leaving my firm and starting my own practice, in his office, and continue the legacy he had started so many years ago.

Tell us about a case that you are particularly proud of:

It is quite ironic. I think most attorneys would answer this question by boasting about their largest verdict but mine is very different, and in fact the exact opposite. We represented a teenager who was hit by a car in a crosswalk who then underwent 9 brain surgeries and was hospitalized for months. He lived in a very poor area and was forced to sleep on an air mattress on the floor of a motel room while trying to recover and regain his life back When we learned that there was very little auto insurance available, I decided to put on a fundraiser to help our client, donating all the money and our services, to his recovery. We ended up raising well over $30,000 by the generous individuals and companies that supported the event.

What does it mean to be a Multi-Million Dollar Advocate®?

The Multi-Million Dollar Advocates Forum® is for those attorneys who have recovered a multi-million dollar award for a client. I think it shows we are willing to take the case all the way to trial if necessary and not just settle for the paltry sums the insurance carriers often offer to see who will budge.

In your opinion, what sets Cohn & Swartzon, P.C. apart from the rest?

We provide not only personalized, but customized legal services to our clients. To begin with, each client will meet with and work directly with an attorney. We understand that there are no two accidents alike, and no two people alike, and therefore specifically tailor our plan of representation to each individual client. We always are ready, willing and able to answer our client's questions and meet with them in person when the need arises. I think above all, because we are selective in the cases we take, and the insurance companies know this, we obtain better results for our clients.

What types of injury claims do you specifically handle?

We handle a large amount of automobile related claims such as auto vs. auto, auto vs. bicycle, auto vs. pedestrian, as well as trucking cases, motorcycle cases, and animal attacks.

How do you view your role in the attorney-client relationship?

First, I view my role in several ways. First, as a counselor in a way, to listen, understand and empathize with my client's position. Second, once I understand where they are coming from, I view myself as strategic, operations planner who devises a plan to battle and overtake the adversary. Lastly, I view my role as a leader and advocate, someone to vigorously represent my client's best interests, even above my own.

What advice do you most often give your clients & why?

I generally advise my clients to focus on getting better. We will do all the rest.

What steps do you take to prepare for a difficult case?

Difficult can mean many things to different people. Obviously, one difficult scenario is handling tragic cases where a son, daughter, mother or father was killed. In that situation, the best way to prepare is to let the family know how much we are on their side so they can focus on the grieving. The other situation is where we know we have a difficult case to prove, either by way of liability or damages. The key in that situation is to make sure we fully, and I mean fully investigate all the facts, interview all witnesses, make sure no stone is left unturned then prepare for battle.

Does it help to have more than a decade of legal experience?

With experience comes knowledge and with knowledge comes wisdom. I have represented hundreds of individuals, both for the plaintiff and many years ago, the defense. Because I have such a diverse experience and background, and have been practicing law for over 20 years, I strongly believe I have the wisdom, knowhow, and reputation to best serve my clients. There are so many traps for the inexperienced or unwary attorney; experience does matter.

Tell us about a turning point in your career:

A turning point in my career was in 2003 when my father passed away. My father was an attorney here in Orange County for many years. In April 2003, my father unexpectedly passed away. At that time I was working for a law firm, representing insurance carriers in the defense of personal injury matters as well as companies in business litigation. Shortly after my father passed, I decided it was time to start my own practice in my father's office and start representing the injured victims against the insurance behemoths whom I had once defended. From that point on, I never looked back and turned what was a tragedy into a legacy.
